Welcome to Millennials for Sustainability.

These Terms and Conditions (“Terms”) govern your access to and use of websites, online platforms, forms, applications, services, programs, training opportunities, memberships, communications, and other resources operated by Millennials for Sustainability (“MFS”), GenY for Earth, and MFS Safety Training Services, collectively referred to in these Terms as “MFS,” “we,” “our,” or “us.”

By accessing our website, submitting a form, creating an account, registering for a program or training course, purchasing a service, applying for a contractor opportunity, participating in an MFS program, or otherwise using our services, you agree to these Terms.

If you do not agree with these Terms, please discontinue use of our website and services.

1. About Millennials for Sustainability

Millennials for Sustainability is a community-centered organization working to build safer, stronger, and more sustainable communities through training, professional services, workforce opportunities, environmental stewardship, community development, and strategic partnerships.

Our activities may include, but are not limited to:

• Safety and emergency-response training

• CPR, AED, First Aid, BLS, and related certification programs

• Workplace and community safety education

• Safety auditing and preparedness assessments

• Youth training and workforce-readiness programs

• Instructor development

• Administrative and operational support

• Janitorial and facility-support services

• Landscaping, grounds maintenance, and environmental services

• General contracting and project-support services

• Transportation and logistics

• Medical courier services

• CDL and non-CDL transportation

• Contractor and subcontractor network development

• Sustainability education

• Community programs

• Land stewardship and development initiatives

• Membership and community platforms

• Educational and digital content

• Public and private-sector contracting

The availability of individual services may vary by location, contract, program, staffing, credentialing, licensing, and other operational requirements.

2. Website Use

You may use our website for lawful purposes only.

You agree not to use our website or platforms to:

• Violate applicable laws or regulations.

• Submit intentionally false or misleading information.

• Attempt to gain unauthorized access to our systems or accounts.

• Introduce malware, malicious code, or other harmful technology.

• Interfere with website functionality or security.

• Scrape, copy, reproduce, or commercially exploit protected MFS content without authorization.

• Impersonate another individual, organization, contractor, employee, or representative.

• Use MFS branding in a way that falsely suggests authorization, employment, partnership, certification, or endorsement.

• Engage in harassment, discrimination, threats, fraud, or other unlawful conduct through MFS platforms.

We reserve the right to restrict or terminate access when these Terms are violated.

3. Accuracy of Information

We make reasonable efforts to provide accurate and current information.

However, website information may occasionally contain errors, omissions, outdated information, or changes that have not yet been reflected online.

Course availability, pricing, schedules, contract opportunities, program requirements, service descriptions, instructor availability, and other information may change.

We reserve the right to correct errors and update information without prior notice.

4. Training and Certification Services

MFS Safety Training Services provides safety and emergency-response education through programs that may be associated with recognized training organizations, including programs for which MFS or individual instructors hold appropriate authorization.

Training may include CPR/AED, First Aid, BLS, Bloodborne Pathogens, bleeding-control education, workplace safety, emergency preparedness, instructor development, and other authorized programs.

Completion of a course does not automatically guarantee certification.

Participants must satisfy the applicable course requirements, including attendance, skills demonstrations, assessments, examinations, or other requirements established by the applicable training program.

Certification requirements may be established by third-party training organizations and may change independently of MFS.

MFS does not represent that every certification is accepted by every employer, licensing board, educational institution, government agency, or regulatory authority.

Participants are responsible for confirming that a particular course or certification satisfies their individual professional, licensing, educational, or employment requirements before registration.

5. Training Is Not a Substitute for Professional Emergency Services

MFS educational content and training are intended to improve preparedness and teach appropriate emergency-response skills within the scope of the applicable program.

Website content, social-media content, classes, downloadable materials, demonstrations, and other educational information should not be interpreted as individualized medical advice or as a substitute for emergency medical services or professional healthcare.

During an actual emergency, individuals should contact the appropriate emergency services and follow applicable emergency-response procedures.

6. Registration and Payment

Payment requirements may vary depending on the service, course, program, contract, or client agreement.

Unless otherwise stated in writing, registration is not guaranteed until required payment or an approved payment arrangement has been received.

Organizations requesting group or onsite services may receive separate proposals, invoices, statements of work, or service agreements.

Those documents may contain additional terms specific to the engagement.

If a separate written agreement conflicts with these general website Terms regarding a specific contracted service, the applicable signed agreement will control for that service.

7. Certificates and Outstanding Balances

Unless otherwise stated in a specific written agreement, MFS may withhold certificates, course documentation, or other deliverables until outstanding balances associated with the applicable service have been paid.

For applicable training services, certificates may be held until the associated invoice is paid.

If payment remains outstanding for more than 30 days, eligibility to receive the certificate or associated documentation may be forfeited where permitted by the applicable certification program and agreement.

Third-party certification organizations may impose additional rules regarding certificate issuance.

8. Cancellations, Rescheduling, and Refunds

Training courses, appointments, and contracted services may have specific cancellation policies disclosed during booking or in a proposal, invoice, contract, or statement of work.

Unless different written terms are provided for a particular service, cancellations made within two weeks of a scheduled service may result in forfeiture of 50% of amounts paid or owed for the scheduled service.

Nonrefundable materials, certification fees, travel expenses, customized products, third-party charges, or costs already incurred by MFS may also be excluded from refunds where disclosed and legally permitted.

MFS may reschedule services due to instructor illness, severe weather, emergencies, facility problems, safety concerns, insufficient enrollment, or circumstances beyond our reasonable control.

When MFS initiates a cancellation, we will make reasonable efforts to provide an appropriate rescheduling, credit, or refund option based on the circumstances and applicable agreement.

9. Corporate and Group Services

Organizations requesting onsite, group, corporate, government, or institutional services may be subject to separate:

• Proposals

• Quotes

• Purchase orders

• Statements of work

• Service agreements

• Government contract provisions

• Payment terms

• Cancellation provisions

• Facility requirements

• Minimum participant requirements

Group pricing, discounts, or partnership rates advertised by MFS may have eligibility requirements and are not automatically applicable to every transaction.

10. Safety Auditing and Assessment Services

MFS may provide safety auditing, preparedness assessments, equipment reviews, documentation reviews, training assessments, and related services.

These services are intended to help organizations identify potential preparedness concerns and improvement opportunities.

Unless expressly agreed otherwise in writing, an MFS audit or assessment does not constitute a governmental inspection, legal certification, engineering inspection, insurance inspection, accreditation, regulatory approval, or guarantee of compliance.

Organizations remain responsible for understanding and complying with laws, regulations, licensing requirements, accreditation standards, insurance requirements, and industry-specific obligations applicable to their operations.

11. Independent Contractor Opportunities

MFS may advertise opportunities for independent contractors, subcontractors, owner-operators, instructors, skilled professionals, and other service providers.

Submitting an application, interest form, credential packet, or contractor profile does not guarantee work, assignments, contracts, hours, income, or selection.

Contract opportunities may depend upon:

• MFS receiving a contract or project award

• Client demand

• Geographic location

• Qualifications

• Experience

• Licensing

• Insurance

• Vehicle or equipment requirements

• Background screening

• Pricing

• Availability

• Contract requirements

• Past performance

• Project-specific eligibility

Independent contractors are responsible for maintaining the licenses, permits, registrations, insurance, equipment, transportation, certifications, and other qualifications required for the services they perform.

Specific contractor relationships may be governed by a separate Independent Contractor Agreement or subcontract.

Nothing contained on the website or in a contractor opportunity should independently be interpreted as creating an employer-employee relationship.

12. Contractor Credentials and Information

Contractors may be asked to provide documentation such as:

• Driver's licenses

• Professional licenses

• Business registrations

• Insurance certificates

• Vehicle documentation

• Motor Vehicle Record authorizations

• Certifications

• Permits

• Equipment information

• References

• Background-screening information

• Tax documentation

• Other project-specific credentials

By submitting information, you represent that the information is accurate and that you are authorized to provide it.

Providing false, fraudulent, altered, expired, or materially misleading credentials may result in disqualification or termination of a contractor relationship.

13. Transportation and Courier Services

Transportation services may be subject to additional requirements depending on vehicle type, cargo, jurisdiction, client requirements, insurance requirements, operating authority, and applicable transportation regulations.

Drivers and owner-operators are responsible for maintaining the credentials and insurance required for the work they accept.

Certain transportation assignments may require additional permits, endorsements, operating authority, cargo insurance, commercial auto coverage, Motor Vehicle Record reviews, background checks, medical qualifications, or specialized training.

Medical courier assignments may also involve additional requirements concerning confidentiality, chain of custody, specimen handling, packaging, temperature control, or other healthcare-related procedures.

14. Construction and Property Services

Construction, general contracting, property maintenance, environmental maintenance, landscaping, janitorial, and related services may be governed by separate scopes of work, contracts, purchase orders, or project specifications.

MFS does not authorize contractors to perform regulated work for which they lack required licensing, permits, qualifications, or insurance.

Project-specific requirements take precedence over general descriptions appearing on the website.

15. Employment and Workforce Opportunities

Information concerning workforce programs, contractor opportunities, instructor pathways, certifications, career development, or job placement is intended to create pathways to opportunity.

Participation does not constitute a guarantee of employment, contract placement, income, promotion, government contract award, or future business opportunity.

Employment decisions made by third-party organizations remain under the control of those organizations.

16. Youth Programs

Some MFS programs may serve minors.

Participation by minors may require parental or legal-guardian consent, emergency-contact information, releases, or other documentation.

Additional program-specific policies may apply to youth activities.

MFS reserves the right to establish age requirements for particular courses, certifications, activities, or platforms.

17. Community and Membership Platforms

MFS may operate online communities, membership platforms, discussion groups, social-media communities, marketplaces, or other interactive spaces.

Participants are expected to communicate respectfully and refrain from harassment, discrimination, threats, spam, fraud, exploitation, or unlawful conduct.

MFS may moderate or remove content and may suspend access when reasonably necessary to protect participants, maintain platform integrity, or enforce community standards.

18. User-Generated Content

If you submit reviews, photographs, comments, testimonials, posts, or other content to an interactive MFS platform, you remain responsible for that content.

You may not submit content that infringes another person's intellectual-property or privacy rights or contains unlawful, fraudulent, defamatory, threatening, or malicious material.

Any use by MFS of a person's name, likeness, testimonial, photograph, or other promotional material will remain subject to applicable consent and privacy requirements.

19. Intellectual Property

Unless otherwise indicated, website materials created by MFS—including logos, branding, graphics, original text, program materials, photographs owned by MFS, videos, publications, downloadable resources, and other original content—are owned by or licensed to MFS.

You may not reproduce, distribute, sell, modify, republish, or commercially exploit protected MFS materials without written permission.

Materials belonging to third-party certification organizations, partners, licensors, or other rights holders remain the property of their respective owners.

20. Third-Party Platforms and Links

MFS may use or link to third-party platforms for services such as:

• Payments

• Scheduling

• Certification management

• Communications

• Community participation

• Social media

• Video conferencing

• Forms

• Government procurement

• Contractor management

• Training delivery

Third-party platforms maintain their own terms, privacy policies, security practices, and operating requirements.

MFS is not responsible for the independent operation or availability of third-party websites and services.

21. Privacy

Your use of MFS websites and services may involve the collection of personal information.

Information may be collected when you:

• Register for training.

• Submit an inquiry.

• Apply for contractor opportunities.

• Join a program or community.

• Purchase services.

• Subscribe to communications.

• Submit credentials or documentation.

• Communicate with MFS.

The collection and use of personal information should also be governed by the MFS Privacy Policy, which should be published separately from these Terms.

Sensitive information should only be submitted through forms or systems specifically designated for that purpose.

22. Electronic Communications

By providing your email address, telephone number, or other contact information, you consent to receiving communications reasonably necessary to respond to your inquiry, administer a registration, manage a service, communicate about a contractor application, or otherwise fulfill your requested interaction with MFS.

Marketing communications will be handled according to applicable consent requirements, and recipients may unsubscribe from eligible promotional communications.

23. Pricing and Availability

Prices, promotions, discounts, schedules, services, and program availability may change.

A website price does not override a subsequently issued project-specific proposal, contract, government award, negotiated agreement, or customized quote.

MFS reserves the right to decline work that falls outside our capabilities, credentials, insurance, licensing, service area, safety requirements, or available capacity.

24. No Guarantee of Results

MFS strives to provide professional, high-quality services.

However, we cannot guarantee particular business, employment, contracting, financial, educational, safety, certification, procurement, or community-development outcomes merely from using our website or participating in an MFS program.

Safety training and preparedness activities reduce knowledge and preparedness gaps but cannot eliminate all risks or prevent every emergency, injury, illness, loss, or adverse event.

25. Limitation of Liability

To the fullest extent permitted by applicable law, MFS will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of the website or reliance on general informational content provided through it.

Nothing in these Terms is intended to waive rights or exclude liability that cannot legally be waived or excluded.

Liability arising from separately contracted professional services may be governed by the applicable service agreement, subcontract, purchase order, statement of work, or other written agreement.

26. Indemnification

To the extent permitted by applicable law and any separate written agreement, users and contractors may be responsible for losses, claims, or expenses resulting from their unlawful conduct, material violation of these Terms, infringement of third-party rights, or services performed outside their authorized scope.

Any contractor-specific indemnification obligations should be stated in the applicable Independent Contractor Agreement or subcontract.

27. Force Majeure

MFS will not be responsible for delays or inability to perform caused by circumstances reasonably beyond our control, including severe weather, natural disasters, public emergencies, utility failures, transportation disruptions, government actions, facility closures, labor disruptions, widespread technology outages, or similar events.

We will make reasonable efforts to communicate and reschedule affected services when practicable.

28. Termination or Suspension

MFS may suspend or terminate access to services, programs, accounts, contractor opportunities, or community platforms when reasonably necessary because of:

• Nonpayment

• Fraud or misrepresentation

• Unsafe conduct

• Harassment

• Material policy violations

• Credential expiration or falsification

• Loss of required insurance or licensing

• Client or facility restrictions

• Unauthorized use of MFS intellectual property

• Violation of applicable law

• Material breach of a separate agreement

Termination of a contractual relationship will otherwise be governed by the applicable agreement.

29. Changes to These Terms

MFS may update these Terms as our organization, services, technology, or legal obligations change.

Updated Terms will be posted with a revised Last Updated date.

Continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

Material changes affecting an existing paid service or contract may be governed by the terms in effect when that agreement was entered or as otherwise agreed by the parties.

30. Governing Law and Disputes

These Terms and Conditions (“Terms”) govern your access to and use of websites, online platforms, forms, applications, services, programs, training opportunities, memberships, communications, and other resources operated by Millennials for Sustainability LLC, a Delaware limited liability company, including its GenY for Earth brand and MFS Safety Training Services division (collectively referred to as “MFS,” “we,” “our,” or “us”).

Millennials for Sustainability is an organization formed in the State of Delaware and may provide services, conduct business, engage contractors, and enter into agreements in other jurisdictions.

Specific training services, construction projects, transportation services, contractor relationships, government contracts, or other professional engagements may be subject to additional federal, state, or local laws and regulations based on the location and nature of the work.

Where MFS enters into a separate written agreement, including a service agreement, independent contractor agreement, subcontract, purchase order, statement of work, government contract, or other executed agreement, the governing-law, venue, dispute-resolution, and other contractual provisions contained in that agreement will control with respect to that engagement.

Before initiating formal legal proceedings, the parties are encouraged to make a good-faith effort to resolve disputes through direct communication and informal resolution when appropriate.

Nothing in these Terms is intended to limit any rights or remedies that cannot lawfully be limited under applicable law.

That gives us the missing formation-state piece without unnecessarily declaring that every dispute from every MFS project must occur in Delaware. That's useful because you're building operations and pursuing contracts in multiple states, and individual government contracts or subcontracts may impose their own governing terms.

31. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

32. Entire Agreement

These Terms, together with the Privacy Policy and any applicable registration terms, service agreement, proposal, statement of work, purchase order, contractor agreement, or other written agreement, constitute the applicable agreement between the parties regarding the services covered by those documents.
